CONTENT CONSENT RELEASE

WatersAbove® ("WatersAbove," "we," "us," or "our") would like to feature your name, image, photo, video, voice, testimonial, and/or likeness (collectively, "Content") on our social media channels, website, and other marketing materials. Submitting your Content does not guarantee that WatersAbove will publish, post, or otherwise use it. But before we do, we need your written consent. By checking the box and submitting this form, you agree to the following terms.
1. Eligibility and Consent Granted
I confirm that I am at least 18 years of age, and I voluntarily consent to WatersAbove® capturing, using, and sharing my Content as described in this form.
If any individual under the age of 18 appears in the Content I am submitting, I confirm that I am their parent or legal guardian, and I am consenting on that minor's behalf to the use of their image, likeness, and voice as described in this release, in addition to consenting on my own behalf.
2. Ownership and Rights Warranty
I represent and warrant that:
a. I own the copyright to the Content, or I have obtained all necessary rights and permissions from the copyright owner (for example, a photographer who is not me) to grant the license in Section 3 below.
b. Any other identifiable individual who appears in the Content — other than a minor covered by my consent under Section 1 — has consented to appearing in the Content and to WatersAbove's use of it as described in this release.
c. I will indemnify and hold WatersAbove harmless from any claim, loss, or expense arising from a breach of the representations in this Section 2.
3. License Granted
I grant WatersAbove a non-exclusive, royalty-free, worldwide license to:
a. Use my name, image, likeness, voice, and any testimonial or comments I provide.
b. Reproduce, edit, and publish this Content on WatersAbove's organic social media accounts (including but not limited to Instagram, TikTok, YouTube, X/Twitter, Facebook, and LinkedIn), website, email marketing, and promotional materials, whether in print or digital form.
WatersAbove is not obligated to publish, post, display, or otherwise use my Content, and submission of Content does not guarantee that WatersAbove will use it or use it in any particular manner.
This license is non-exclusive — I am free to continue posting the Content on my own accounts. This license does not include the right to use the Content in paid advertisements; separate written permission is required before WatersAbove may use the Content in paid or sponsored placements.
4. Purpose
This Content will be used solely for promotional, marketing, editorial, and community-building purposes related to WatersAbove. It will not be sold to third parties or used in a manner unrelated to WatersAbove®.
5. Testimonial Accuracy
Any testimonial, comment, or statement I provide reflects my own genuine, honestly-held opinions and experiences, and is not misleading.
6. Compensation
I understand that I will not receive any payment, royalty, or other compensation for the use of my Content.
7. Duration and Right to Revoke
This consent remains in effect until I revoke it in writing (email is acceptable) to support@watersaboveuniversity.com. I understand that:
a. Revocation will stop future use of my Content, but WatersAbove is not obligated to remove Content already published or shared prior to revocation.
b. Some previously published Content may remain visible due to sharing, caching, or archiving by third-party platforms outside WatersAbove's control.
c. To verify my identity when revoking consent, I must contact the address provided along with my full name as provided in the form.
8. Governing Law
This release is governed by the laws of the State of Virginia, without regard to its conflict-of-law principles. Any dispute arising from this release will be resolved in the state or federal courts located in that state.
9. Severability
If any provision of this release is found to be unenforceable, the remaining provisions will remain in full force and effect.
10. Electronic Signature
By checking the box provided in the form and submitting this form, I am providing my electronic signature. I understand this has the same legal effect as a handwritten signature, and I agree to be bound by the terms of this release.
